The USPS Recognizes Potential Consequences of Ruling
On Feburary 19th, 2021, USPS opened a proposed rule with invitation for public comment. This document outlines the complications 'Publication 52' poses to their already struggling business, and addresses the issues of nonmailability of ENDS products as well as exceptions regarding these products.
The United States Postal Service is accepting feedback from the public regarding the new bill that will essentially ban shipments of vapor products to consumers. The feedback and suggestions from the public can serve as a contribution of evidence concerning the effects that the ban will have on users of ENDS (Electronic Nicotine Delivery System) products.
The Summary of USPS' stance on Publication 52
"The Postal Service proposes to revise Publication 52, Hazardous, Restricted, and Perishable Mail, to incorporate new statutory restrictions on the mailing of electronic nicotine delivery systems. Such items would be subject to the same prohibition as cigarettes and smokeless tobacco, subject to many of the same exceptions."
"It is not intuitive that ENDS should be understood as a form of “cigarette.”

The call to action makes it clear that submitting a comment will not be able to change the ruling. However, submitting a comment is valued and serves a purpose. It provides a record of public opinion on the matter. It also aids anticipation of what consequences the USPS can expect as a result of the ruling. The deadline to submit your comment is March 22, 2021.
